2nd Failed execution in Tennessee in 2026 [1, 6]
29 US executions in 2026, all by lethal injection, as of early October [8]
THE STORY IN BRIEF Tennessee's attempt to execute Christa Pike, 50, the only woman on the state's death row, failed on Wednesday, 30 September. She was given an initial and a backup dose of the execution drug but did not die, and was taken to hospital in critical condition. [1, 2, 3] Governor Bill Lee indefinitely postponed her execution and the one other execution scheduled for 2026, and ordered an independent review. Pike's lawyers say the attempt amounted to torture and want her sentence commuted. [2, 5] EDITORIAL FOCUS This briefing separates what officials have confirmed, what lawyers and witnesses allege, and what remains unexplained. The cause of the failure has not been publicly established.
THE DAY AS REPORTED Before the execution | Clemency denied. Pike was sentenced to death for the 1995 murder of a classmate. Governor Lee denied her clemency petition on Monday, 28 September, two days before the scheduled execution. [5, 7] In the chamber | Two doses. Pike was strapped to a gurney at Riverbend Maximum Security Institution in Nashville and described herself as being at peace. After the lethal drugs were injected, she did not lose consciousness and her heart kept beating. She was still snoring when the chamber microphone was cut off more than an hour into the attempt. [1, 2, 4] Afterwards | Emergency motion and hospital. Her legal team filed an emergency motion with the Tennessee Supreme Court. Pike was taken to hospital by ambulance. [1, 3] Thursday, 1 October | Critical condition. Her lawyers said she was alive and receiving lifesaving care, but that they had no clear picture of her prognosis. [2, 4]
WITNESS ACCOUNTS May Martinez, the mother of the woman Pike murdered, travelled to Nashville to watch the execution and told NBC News it was a mess. Some media witnesses said their view was blocked several times. These are accounts by those present, not official findings. [2, 7]
INSTITUTIONAL REACTIONS The governor. Lee called the outcome deeply disturbing and said it appeared prison staff had followed procedure. He ordered what he described as a comprehensive, third-party review to determine exactly what occurred. It was not immediately clear who would conduct it. [1, 3, 7] The defence. Pike's lawyer Randy Spivey called the attempt torture. Her legal team has asked the governor to commute her death sentence to life imprisonment, a request he had rejected before the execution. [3, 5] Expert view. One death penalty expert told the Associated Press the failed execution was unprecedented. An Oklahoma City anaesthesiologist with no link to the case said that if staff used a small vein, the drug could have caused some burning, as Pike's lawyers mentioned. [2]
A PATTERN, NOT A ONE-OFF Date
Event
Outcome
2022
Execution of Oscar Smith halted
State admitted it had failed to ensure its lethal injection drugs were properly tested [2]
May 2026
Execution of Tony Carruthers halted
Staff spent more than an hour failing to set up an IV line; oneyear reprieve granted [6, 7]
30 Sept 2026
Execution of Christa Pike fails
Two doses given; Pike survives; executions halted for the year [1, 2]
The doctor involved in the failed Carruthers attempt, Mark Fowler, also oversaw Pike's lethal injection. A complaint was filed with the Tennessee Department of Health alleging the Carruthers attempt caused serious injuries. [6, 7] The national picture. Every US execution in 2026 has been carried out by lethal injection. Idaho made the firing squad its primary method on 1 July, a federal judge permanently blocked Alabama's nitrogen gas protocol, and Ohio has kept issuing reprieves because drug suppliers will not provide execution drugs. THE LEGAL QUESTIONS Provision
What it covers
Why it matters here
Eighth Amendment, US Constitution
Bars cruel and unusual punishment
The basis for the defence's torture argument and any challenge to a second attempt
Louisiana ex rel. Francis v. Resweber (1947)
US Supreme Court allowed a second execution after the electric chair failed
The main precedent on whether a state can try again after a failed execution
Baze v. Rees (2008), Glossip v. Gross (2015)
Upheld lethal injection protocols; require a feasible, less painful alternative
The test any method-ofexecution challenge must meet
Executive clemency
Governor's power to commute a sentence
The route Pike's lawyers are now pursuing [3, 5]
The Indian comparison. In Deena Dayal v. Union of India (1983), the Supreme Court upheld hanging as a constitutional method of execution. A petition seeking a less painful alternative, Rishi Malhotra v. Union of India, has been pending before the Supreme Court. Under Article 21, Indian courts have also held that inordinate delay and mental anguish on death row can justify commutation, as in Shatrughan Chauhan v. Union of India (2014). Legal explainer: these provisions and cases are relevant to the events; this is not a finding that any specific action violated the law.
WHAT TO WATCH • • •
The review. Who conducts the third-party review, and whether its findings are made public. Clemency. Whether Governor Lee reconsiders Pike's request for commutation after the failed attempt. Litigation. Whether Pike's lawyers bring an Eighth Amendment challenge to any future attempt, and how courts apply Resweber today. EDITORIAL CAUTION Pike was convicted of murder and acknowledged her role in the killing. The suffering of the victim's family and the questions over the execution are reported side by side; this edition takes no position on the death penalty itself.
